Domain names
A domain name is an
Internet address,
used for a Web site. Increasingly, the domain name has become a distinctive sign for a company.
There might be c
onflicts between trademarks and domain names
. Thus, if you choose a domain name already used by a registered trademark, you may be convicted for infringement of the rights over the trademark. By the same token, if your trademark is used in an illicit way as a domain name by a third party (
one speaks here of "cybersquatting"
), you may enforce your rights.
The charter for the naming of the
.ma
domain provides - for the resolution of litigation between a domain name and a trademark - for the recourse to an administrative procedure,
managed by the WIPO Mediation and Arbitration Center
, for the settlement of litigations related to domain names. If you do not manage to settle the litigation amicably by this means, you may start a legal action.
